Introduction

The owners of 26 Bel Air Rd, Hingham, MA 02043 are requesting proposals for the purchase of the property in as is-where is condition. Below are the details of the structure and timing of the proposed transaction.

 

Process and Timing

  • Interested parties are invited to submit a bid via email to twentysixbelair@gmail.com on or before November 15, 2024 (“Bid Deadline”).  Bids must include proposed purchase price, closing date and any financial contingencies for closing. 

  • Within five (5) business days of the Bid Deadline, the owners will select parties that are eligible for a walk-through of the property (no detailed inspections are permitted as the sale is in strictly as is-where is condition). Prior to any walk-through of the property, a selected bidder must provide adequate proof of funds to the owner as a condition precedent to completing the walk-through.  The dates of the walk through will be determined by the owners. 

  • Upon the completion of the walk through, the selected bidders will have three (3) business days to provide their best and final bid which must include purchase price, closing date and any financial contingencies for closing.

  • Within three (3) business days of receipt of the best and final bid submissions, owner will inform the selected bidders of its decision to proceed. Bid selection is at the sole discretion of the owners.  If selected, the selected bidder and owners will proceed with the closing of the as is-where is transaction based on mutually agreed legal documents. 

  • In any event, the closing of the transaction must occur no later than December 31, 2024.

 

As Is Where Is Sale

By submitting a bid for the property, all bidders unconditionally agree that the property will be sold and purchased in an “as is, where is” condition and no term, condition, warranty, representation or covenant of any kind has been made or is given by the owner or its agents in respect of the value, quality, durability, condition, design, or description of the property, as to the absence of latent, inherent or other defects (whether or not discoverable), all conditions, warranties and representations (or obligation or liability, in contract or in tort) in relation to any of those matters, expressed or implied, statutory or otherwise, are expressly excluded and the all bidders hereby waive, release and renounce all such terms, conditions, warranties, representations or covenants by the owner or its agents.

The owner makes no representation or warranty as to the accuracy or completeness of any information provided to bidders whether by written or oral communication.

The owners expressly reserve the right, without reasons therefore, at any time and in any respect, to decide not to sell the property described herein, to remove the property from the market for sale temporarily or permanently, to terminate discussions with any or all bidders or to negotiate with any party, or parties with respect to the property, regardless of whether such party, or parties, is the highest bidder or not.
